What is a fixed term contract? Regulation 1(2) of the Fixed Term Employees (Prevention of Less Favourable Treatment) Regulations 2002 (“the Regulations”) defines fixed term contracts as contracts ending: on the expiry of a fixed term; on the completion of a particular task; or; on the occurrence or non-occurrence of any other specific event. Fixed-term contracts (FTC) represent a lower level of protection for workers in terms of termination of their employment, as no reason need be given by the employer to end the relationship. There is no option for employees to transition to permanent employment, Early termination of a fixed-term contract will result in a breach of contract, unless the contract contains an early termination clause allowing either party to give notice. Where the contract allows the employer to end it early by giving notice, the employee will be entitled to the statutory minimum notice applicable. Early Termination of a Fixed-Term Contract. Without an early termination clause, an employer will not be able to end a fixed-term contract before its end date. Just having an early termination clause doesn’t always protect an employer.
